REGULATIONS OF THE LOYALTY PROGRAM "GOLDEN CARD"
§1 Introductory provisions
1 The loyalty program "Golden Card" (hereinafter referred to as "Program") is offered by TONY Sp. z o.o. Sp.k. based in Wrocław (hereinafter referred to as the "Organizer").
2. The purpose of the Program is to reward regular customers of the Organizer by providing them with discounts and benefits.
3. The Program is addressed to persons who meet the conditions specified in these Regulations (hereinafter referred to as "Participants").
4. These Regulations define the rules of participation in the "Gold Card" Program.
5. By accepting the Regulations, the Participant agrees to its terms and agrees to abide by them.
6. All questions and concerns regarding the Program and the Regulations should be addressed to the Organizer.
§2 Terms and conditions
1. Participant of the Program may be any existing or new customer of the Organizer, using its educational offer.
2. In order to participate in the Program it is necessary for the Participant to physically receive the Golden Card.

§3 Benefits
1. Program Participants are entitled to enjoy the following benefits offered by the Organizer:
► a unique discount (from 12 to 15% depending on the number of paid classes).
► free admission to all events with an accompanying person
► free participation in one workshop per year
► access to Tons on unattended days (excluding dates when Tons is closed for technical reasons)
2. The Organizer may introduce and modify the benefits offered to Participants at any time.
3. Additional benefits offered to Participants may also be specified on the Organizer's website.
§4 Participant's obligations
1. The Participant is obliged to use the Golden Card in a manner that prevents its use by third parties.
2. The Participant, in connection with the use of the Golden Card during events organized by the Organizer, is entitled to take one bystander with him/her.
3. Each time the Golden Card is used, the physical possession of it by the Participant is required for verification.
4. The Participant is obliged to use the Golden Card in a manner consistent with the Regulations and applicable laws.
5. the Participant is not entitled to assign rights and obligations under these Regulations.
§5 Changes
1. The Participant may at any time resign from participation in the Program.
2. The Organizer may terminate the Program or make changes to the Regulations at any time. The current Regulations are available on the Organizer's website.
3. The Gold Card is terminated or if the Participant violates the Terms and Conditions.
§6 Personal Data
1. The Participant agrees to the processing of his/her personal data by the Organizer for the purpose of proper implementation of the Program, including sending information and updates regarding the Program and new benefits to the e-mail address or telephone number indicated by the Participant.
2. The administrator of the personal data is Tony Sp. z o.o. Sp. k. with its registered office in Wrocław at Pl. Orląt Lwowskich 20c.
3. Personal data shall be processed for the purpose of implementing the Program.
4. Personal data shall not be subject to automated decision-making, including profiling.
5. Personal data will not be transferred to a third country or international organization.
6. Personal data will be stored for the duration of the legal relationship linking the person to whom the Gold Card is issued and for a period of 6 months after its termination or expiration.
7. Under the terms of the provisions of the RODO, the person whose data is processed has the right to:
(a) access to his/her personal data,
(b) to request from the controller the immediate rectification of personal data that is inaccurate,
(c) demand from the controller the restriction of processing when the data subject disputes the accuracy of the personal data - for a period that allows the controller to verify the accuracy of such data, and also when the controller no longer needs the personal data for the purposes of processing, but the data are needed by the data subject to establish, assert or defend claims,
(d) demand from the controller the immediate erasure of personal data concerning him/her where the personal data are no longer necessary for the purposes for which they were collected or otherwise processed, and where the personal data must be erased in order to comply with a legal obligation under Union or Member State law to which the controller is subject,
e) lodge a complaint to the President of the Office for Personal Data Protection (Stawki 2 Street, 00-193 Warsaw) when the data subject considers that the processing of his/her personal data violates the provisions of the RODO.
(8) Provision of personal data is voluntary and necessary for participation in the Program.
§7 Final Provisions
1. The Regulations shall enter into force on 20 February 2023 October.
2. Any disputes arising in connection with the Program shall be settled by a court having jurisdiction over the seat of the Organizer.
